Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Autoshot (the "Service"), an AI-powered vehicle damage assessment and trade-in pricing platform for used-car dealers. By creating an account, accessing, or using the Service — including as a guest — you agree to be bound by these Terms. If you do not agree, do not use the Service.

1The Service

Autoshot lets you upload photographs of a vehicle and receive an automated assessment that may include detected damage, an identification of the vehicle, an estimated market price, and a generated PDF report. The Service combines a computer-vision damage-detection model, third-party AI vision services, and live or estimated market-pricing data drawn from public sources across multiple countries.

We may add, change, suspend, or remove features at any time. Some features depend on third-party providers and may be unavailable or degraded if those providers experience outages.

2Accounts & Eligibility

You must be at least 18 years old and capable of forming a binding contract. You may register using Google sign-in or an email and password. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. Guest mode allows a limited number of free assessments per network address and does not require an account.

You agree to provide accurate information and to keep it current. We may suspend or terminate accounts that contain false information or that are used in breach of these Terms.

3Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose;
• Upload photographs you do not have the right to use, or images containing other people's personal data without a lawful basis;
• Attempt to reverse-engineer, scrape, copy, or extract the underlying models, datasets, or source code;
• Circumvent rate limits, guest-mode restrictions, billing, or access controls;
• Resell, sublicense, or white-label the Service without our written permission;
• Interfere with, overload, or disrupt the Service or the networks it relies on;
• Use automated means to access the Service except as we expressly permit.

4Assessments Are Estimates — Not Guarantees

You must not rely solely on an Autoshot assessment to make a purchase, sale, trade-in, valuation, or other business decision. Autoshot is a decision-support tool intended to assist a qualified human professional. You remain fully responsible for independently verifying the condition, identity, history, and value of any vehicle — including through physical inspection — before committing to any transaction. We make no representation that an assessment is accurate, complete, or fit for any particular purpose.

5Subscriptions, Billing & Payments

Paid plans (such as Solo and Dealer tiers) are billed through our payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis (monthly or as otherwise stated at checkout) until you cancel. Prices, included usage, and plan features are described at the point of purchase and may change with notice for future billing periods.

• Renewal: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation: You may cancel at any time through your account or the billing portal. Cancellation takes effect at the end of the current billing period; you retain access until then.
• No partial refunds: Except where required by law, fees already paid are non-refundable, and we do not provide refunds or credits for partial billing periods, unused assessments, or downgrades.
• Taxes: Stated prices may exclude applicable taxes, which are your responsibility.
• Failed payments: If a charge fails, we may suspend or downgrade paid features until payment is resolved.
• Fair use of "unlimited" plans: Paid plans include unlimited vehicle assessments for normal, good-faith dealership use by the licensed users on the plan. "Unlimited" does not permit automated/bulk scripting, resale of the Service, sharing one account across more users than your plan allows, or usage that is excessive relative to comparable customers. If usage materially exceeds reasonable single-operation patterns, we may contact you to move to a plan that fits, apply reasonable rate limits, or suspend abusive activity.

6Your Content & License

You retain ownership of the photographs and data you upload ("Your Content"). You grant Autoshot a worldwide, non-exclusive, royalty-free license to host, process, and analyze Your Content to provide the Service, and — as further described in our Privacy Policy — to improve, train, and retrain our detection models. You represent that you have all rights necessary to grant this license.

7Intellectual Property

The Service, including its software, models, training datasets, user interface, logos, and content (excluding Your Content), is owned by Autoshot and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service in accordance with these Terms. No other rights are granted, whether by implication or otherwise.

8Third-Party Services

The Service relies on third-party providers including Anthropic (AI vision), Google (authentication), Stripe (payments), Sentry (error monitoring), and public market-data sources. Your use of features that depend on these providers may also be subject to their terms. We are not responsible for the acts, omissions, or availability of third-party services.

9Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any assessment, detection, or price will be accurate or reliable.

10Limitation of Liability

To the maximum extent permitted by law, Autoshot and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business — including any losses arising from a purchase, sale, valuation, or trade-in decision made in reliance on an assessment — whether based in contract, tort, or any other theory, even if advised of the possibility of such damages.

To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to Autoshot in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (EUR 100). Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.

11Indemnification

You agree to indemnify and hold harmless Autoshot and its owners and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

12Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access — with or without notice — if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13Governing Law & Disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. You agree that the courts located in Barcelona, Spain will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable mandatory consumer-protection law provides otherwise.

14Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide reasonable notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
